Extent of application

These General Terms and Conditions are the legal basis for all services offered on this website.

They apply from 1 August 2016 (current version).

Initiation of a contract

A contract for a service to be provided by publisher is initiated when

1.) An applicant transfers a defined sum of money, using the form of payment specified,

2.) The email address of the applicant is provided in easily readable form on the payment transfer

Once a contract has been initiated, the customer will receive a welcome message at the indicated email address promptly after receipt of the fee in the account. This sets the starting time of the customer relationship. These General Terms and Conditions constitute an integral part of the agreed contract. In making the payment, the applicant declares that he accepts this.

Fees and terms of payment

The amount paid into the account determines the length of the contract:

Contract duration of two months = 65 US Dollar

Other amounts paid into the account cannot be assigned and no contract results.

Payment is to be made either by prepayment (bank transfer) or by PayPal.

Provision of service

The service is provided by the dispatch of emails to the customer at irregular intervals. The content of these emails is an automatically calculated indication of the future direction of the Dow. Publisher does not claim that this indication necessarily corresponds to reality.

The signals delivered are:

Enter Long = Opening a new long position (prices rising)

Enter Short = Opening a new short position (prices falling)

Exit = Close the current long or short position

Normally, several signals per month are generated. However, the service is considered to have been provided even if, due to current stock market conditions, no signal is sent for a longer period of time.

Publisher operates on trading days of the US stock exchange. Signals are calculated during each trading day on the basis of the real time Dow prices.

Further development of the systems and the implementation of new programme versions without disruption do not constitute any restriction of the service delivery.

Use of the signals

The signals sent may only be used by the customer for personal purposes. The transfer of any signal information to third parties is prohibited. Commercial use of the signals (e.g. through further sale of the signal information of by the sale of services and products based upon the signal information) is also prohibited. In both cases, publisher acquires the right to compensation.

Right of revocation

Publisher offers a right of revocation within 11 days of the initiation of a contract. It is sufficient if the revocation is sent within the time period without indication of the reason. After the revocation is received within the time limit, a refund will be made of the amount paid in.

Liability

The contents, information and trading suggestions do not solicit the purchase or sale of financial products and also do not constitute any kind of investment advice. They should neither explicitly nor implicitly be considered as assurance of a particular price trend or as a solicitation to take action. The acquisition of securities involves risks that may lead to the loss of the entire capital invested or more. The information does not in any way replace professional investment advice tailored to the needs of the individual.

Publisher takes no responsibility for pecuniary losses, either explicitly or tacitly.

Publisher will make all efforts within its power to provide its service in accordance with the agreement, but difficulties may arise outside the control. These consist primarily of transmission failures, difficulties in accessing servers or gateways or other network operator failures.

Disruptions under the control will be ended as quickly as possible and customers will be informed about the interruption. This voluntarily assumed duty of information only applies if, during the time when a system was down, the system has generated or would have generated signals which could not be sent to the customer due to the unavailability of the system. Problems relating to external service providers will be reported to them at once.

Publisher takes no responsibility for the receipt of information in the networks of other operators. In particular, publisher takes no responsibility for losses following delays or failure to deliver services in the networks of other operators.

Unforeseeable events such as acts of god, strikes, official actions, failures of transmission mechanisms and similar events for which publisher is not responsible absolve from the duty of service. Publisher will make all reasonable efforts to bring such disruption to an end as soon as possible.

Termination of the agreement

The agreement ends automatically after the expiry of the period associated in the Fees and terms of payment section with the amount paid.

After the expiry of the agreement, the email address of the customer will be removed from the distribution list. No other actions are required of the customer or publisher. The customer relationship is considered to have ended.

Final conditions

All communications will be sent to the customer by electronic means.

All communications from the customer should be sent by electronic means. Contact form and email address are available for this.

If any provision of this agreement is or becomes invalidĀ or if the agreement contains any gaps that need to be filled, this does not affect the validity of the other provisions. The invalid provision or gap is replaced by a regulation which corresponds as closely as possible to the economic purpose of the agreement and which would have been agreed by the parties if they had been aware of the invalidity of the provision.

The protection of your personal data and data protection in general are important. We should therefore like to inform you in this data protection statement about which data are stored by us and how they are used. We should like in this way to meet your need for security and certainty.

Data collection

Our web pages can in principle be visited without the entry of personal data. No person-related data are stored on our servers. Only data required for security purposes are stored, such as the name of the Internet Service Provider, the web page from which you accessed us, our web pages that you visit and the IP address. Even if identification is thereby possible, no person-related use is made of these data. Analyses may only be made for anonymous statistical purposes. The duration of storage depends on the service that you order and is limited to the time required, unless other requirements are stipulated by law.

Publisher protects the data that you provide by technical and organisational measures from accidental or deliberate manipulation, loss, destruction or access by unauthorised individuals.

In order to prevent unauthorised transfer or misuse, any transfer of person-related data will be exclusively in encrypted form. Reflecting our interest in data security, these security measures will be reviewed and updated on an ongoing basis to increase the level of security.
